Compliance with Rules
Section 7 – Compliance with Rules: The following action may be taken for non compliance with the rules:
(t) Warning will be sent on SOLD listings effective March 1, 2019. Rules will apply only to listings that MLS Administrator receives a correction notification. Corrections must be sent to the MLS Administrator within 72 hours or a penalty will apply. Note: Currently these rules only apply to all other status listings, except for SOLD. (Amended October 13th, 2020)
Section 1.17 – Photos
8. Primary Photo must show the entire front of the property and must not cut off part of the property. (Amended July 30, 2020)
11. Primary Photo must fill the space allotted in the MLS system. (Amended July 30, 2020)
All fines may be appealed. All appeals must be submitted in writing to the MLS administrator within 72 hours (3 days) of receiving violation notification. If appeals are submitted within the 72 hrs. of time period, the fine will not be collected until the appeal has been reviewed by the Committee. If appeal is denied, the fine will be collected within 10 days as per MLS Rules and Regulation. (rev. July 30, 2020)
Section 5.0.1 – Disclosing Potential Short Sales:
Note 7: Multiple Listing Services shall not publish listings that do not include an offer of compensation expressed as a percentage of the gross selling price or as a definite dollar amount, nor shall they include general invitations by listing brokers to other participants to discuss terms and conditions of possible cooperative relationships. (Adopted 06/20)
Section 7 – Compliance with Rules:
(m) All fines may be appealed. All appeals must be submitted in writing to the MLS administrator within 72 hours (3 days) of receiving violation notification. If appeals are submitted within the 72 hrs. of time period, the fine will not be collected until the appeal has been reviewed by the Committee. (r) On the Zero Tolerance Rule: Fines will be increase per agent who receive over 3 violations per calendar month from $10.00 to $50.00 and will be assessed on the 4th violation. If agents receive a 5th violation in the same calendar month the fine will increase to $100 per fine and it will be mandatory for the Agent(s) to take an MLS class within 30 days after the fine is assessed. Section 7- Compliance with Rules:
(t) When a Broker inputs a Coming Soon-No Show Status Listing, Broker is required to send within 72 hours to MLS Administration the following written authorization from seller: Coming Soon-No Show Status Seller Authorization form. (Adopted 11/2018) (June 20, 2020)
Section 1.17 – Photos
3. Architectural photos /drawings of front elevation are allowed as primary photos on new construction listing (The following disclaimer must be shown on caption of photo: PHOTO SHOWN IS FOR ILLUSTRATION PURPOSES ONLY). New construction photos must be updated as the building progresses and should be updated at least once a month. (Amended April, 23, 2020)
Section 6 – Service Charges
d. Any Member that drops out of MLS for one quarter must re-apply for MLS PARTICIPATION, AND PAY INITIAL PARTICIPATION FEES, RECURRING PARTICIPATIONS FEE and any past due fees and charges before being reinstated. (Adopted 7/09/2019)
